From Russia with Love Piracy



How should Microsoft Chairman Bill Gates respond to former Soviet leader Mikhail Gorbachev's plea for mercy for a Russian middle school principal?

That is the question I pose to Microsoft Watch readers today. My colleagues and I have been debating this situation, which may be more complex than it appears.

Quick recap: Yesterday Gorbachev posted a letter (Google translation) to Gates about principal Alexander Ponosov, who is destined for a Siberian prison camp. His crime: Buying PCs for the school with pirated software. From one view, Gorbachev's plea to Gates is sensible. Microsoft only licenses software, retaining full ownership.

Gorbachev contends that Windows was already installed on the computers, making Ponosov an unwitting software pirate.

But the issue may be more complex, when weighing local laws, rampant piracy in Russia or Microsoft's possibly opening a Pandora's box of similar requests. On the other hand, Microsoft has aggressively worked with local governments to stiffen laws, which could unfairly treat innocents. Then there is the publicity, which could hurt Microsoft's image in Russia and elsewhere, leading to justification for more piracy.

According to the BBC, even Russian President Vladmir Putin expressed anger at the situation, saying investigators should "go after the distributors, not the users." The International Herald Tribune reported yesterday that Microsoft has declined to intervene on Ponsov's behalf; his copyright infringement is 266,000 rubbles, or about $10,000.

I wrote yesterday: "Somebody at Microsoft should just pay for the damn software. Gates should consider making a donation to Ponosov's school."

Didn't Microsoft offer to give people genuine copies of Windows if they provided details of they were duped into buying counterfeit software. Seems they must have forgotten this offer. If Microsoft start to go down the same path as the RIAA and start suing everybody who uses pirated software then they may find they have no-one to sue pretty quickly - because everyone will be using Linux. (No doubt they will somehow try and sue you for using Linux as well)

Too late now. Whatever they do, Microsoft will come out of it as either villains or wimps. Historically they always liked the villain tag better.

If this causes anyone to change to Linux, people will see it as the nerdcore distraction it is, and quickly find the roubles needed to use whatever crap MS throws at them.

Linux is not for normal people. It's for people who like it when their computers break, so they can program into the early hours with the aid of Red Bull.

Despite being free, it has effectively no marketshare. That's right, you can't even give it away.

Well then Ben, perhaps Linux is the ideal platform for use in school's then. They can teach the children how to fix the computers when they break.
And the money the school saves on MS licensing they can buy some books, or desks, or employee a another teacher.

Well, too bad for your whiners. The Russian government's plan to migrate to Linux is finally becoming a reality.

Thank you for interest to events from our country. Yes, i'm from Russia. And sorry for my weird english. But i strongly support Microsoft. Piracy in any form must have no mercy. So called "piracy" is just a "nice term" for thiefs. I like to eat from gold plates, but i don't steal it from museums or jewelry shops. I'm going to supermarket and buying regular cheap plates. If someone have not enough cash to buying Microsoft or Adobe products, he must buy (or download) free or cheap similar software. I'mean Linux, Gimp, Mozilla, Firefox, Thunderbird, etc. Why my position so "cruel"? Because i'm former programmer, co-owner of outsource programming company and some of my software solutions also was stoled many times. One more time sorry for my realy bad english. Sadly, i have not enough skills to discuss and public all my emotional minds about thievery.

Sorry for the off the wall kind of stuff, but I am a musician. Me and my co-workers worked hard on our latest album and it took us a long time to do. I heard that some kid's in the playground was swapping tapes with out tracks on. I have contacted my lawyer and you have my assurances that have arranged for those children to placed in a young offenders institute for 2 years. I have no time for the tears of their parents. They have stole from me. I know I should go after the dodgy guy with the CD duplicator in his lock-up but I am a bit worried about the fact he owns several guns. At least I have took a few of his customers away, that should **** him off a bit.

I read both Vazlav and Williams comments with much concern.

Firsly, Vazlav with using open source the copyright and credit for your creation would be on going. The value and personal satisfaction of many peoples using your created software would surely be more rewarding than a few purchasing it. Our world "society" has become much about it's mine, mine and you have to pay, instead of the idea of sharing and encouraging community use. The idea of licensing your creations for companies to use as well to create an income or providing support for the use of your software can be an alternative as well.

Secondly, William as a musician (performer) myself I cannot understand your going after people who are merely obtaining copies of your music to listen to. It has been shown that where music groups have provided their music :free: on the internet for sharing have increase exposure and the "brand name" of their group\talent, than having music stores sell only cd through stores.

As a human race we have become to fixated on monetary value for items, rather than their worth to community and society through knowledge and sharing. If the science world of the past were fixated like we are now, we would have never shared in theories of 'relativity' or 'gravity'.

It's something that 'capitalism' has much to answer for..

Hmm... Jack, i was born in most "society-oriented" country in the world. 31 years ago in communistic USSR. And i know one thing - without private property and authors rights - live is realy ugly. When i was schoolboy i have all and i have nothing. I'm proudly can proclaim myself as a "self-made man". Not like so-called "russian oligarh". I'm not spent my time for fun. I'm hardly work and learn programming, while all my coeds dancing, drinking and making sex :) And my ex-coeds now mostly poor man. And why i must support loosers, sharing with him results of my hard work for free? Wow. I wrote it. Do you realy can understand my english? It's surprise for me :)

I am with you i think unless the person who creates it makes it free, others do not have right to steal it. Whether you are happy by sharing or selling depends on individual and economics.

I know how hard microsoft people work to make a software like any other company.

Let's start by just sayin you are not Russian. Never was. You don't understand what's going on there and why many people (not only poor sudents and teachers) prefer to copy (not to steal - those are different matters) and use software that Microsoft thinks cost that much.
I am not protecting piracy. This is something else. Piracy is when someone makes money by reselling or distributing something not belonging to them. In this case a teacher (also school director) never did anything that would compare to what you give as an example - stealing from museum. Think about this - that school would NEVER buy Microsoft software if that was the only way. Microsoft software in Russia is overpriced. For schools it cost more, for example, than in USA for students. Microsoft does nothing to make this situation better. And if you think you can judge other people by saying they waste their time while you hard working, you have my pitty. You most likely don't have kids. Try to teach them first - you will get an idea what it's like real world.
If I make a song and a kid copies it to someone else - let it be. More people will hear my song and I am glad to help them to be happy.

Let's start by just saying i AM russian. Not "pure-blood-russian", but real soviet russian. In my veins blood from russian, scandinavian, jews, greeks and many other nations. Read my blog as a proof (link to blog is under my name). Piracy equals thievery. Yes, i have not kid, you right. But only because i have not time for it. It's sad, but is it true. Me and my wife working hard everyday to earn more money for happy future for our kids. And why i must support couples who not working hard and have not enough money to buy LEGAL music or computer games for kids? I don't want support thiefs. You said: "for education or noncommercial usage people have rights to steal"? Nonsense! If people have not enough money, why they don't want using cheaper or free software? Answer is lazy. Using linus (for example) is little bit harder for non advanced people. But for more comfort people MUST pay. They have a freedom of choice - free or pay. Linux, OpenOffice, Inkscape, Mozilla - it's good software. Why "poor" people don't use it?
You said: "Microsoft software in Russia is overpriced". Overpriced compared with what? Windows XP (OEM Home edition) costs $49 or 1200 Rub. This is a cost of 50 bottles of cheap beer, or 5 bottles of vodka, or 5 tickets to cinema, or it is cost of ONE "funny night" in night club. Is it overpriced!? "Piracy" version costs $5. But without warranty, official support and with high risk of "injected" spyware or other trojans.
Microsoft Office. Yes. It's little expensive. But WHY people in Russia prefers PRO, CORPORATE and ENTERPRISE edition for NON-COMMERCLAL usage? Well, i have money to buy MSOffice. But i know price of money. And i'm still using free OpenOffice Suite.
Adobe Photoshop. Expensive stuff. But people who using Photoshop "for free" needs only 5-10% of Photoshop potential. Why don't get free and easy software (e.g. like Picasa)for editing home photos? Corel Draw have easy and free alternative - Inkscape. Etc, etc, etc.

I feel so sorry for those children you had locked up. They didn't know it was stolen music. You should have gone after the music pirate, even if he does own many guns. If you're afraid of doing it yourself, have your lawyer do it. The fact is, those innocent children do not deserve to be locked up just because some selfish musician is upset that someone ELSE duplicated the music. HE stole from you, not the children.

Secondly, racism is a dangerous ideology because it promotes unnecessary violence and hatred. Historically, racism has been a motivating factor and a justification for violence, slavery, and war. Racism has started several wars and killed millions of people. I believe that racism is incompatible with a civilized society.

In addition, racism promotes the use of false stereotypes. Incorrect generalizations are sometimes promoted by the mainstream media. For example, Time magazine came under criticism for altering a photograph of Orenthal James Simpson to make his skin appear darker. African Americans believed that Time magazine had promoted racism by perpetuating the stereotype that African American men commit violent crimes.

In support of Article 21 of the United Nations Universal Declaration of Human Rights, every human being has the right to freedom from discrimination. Racial discrimination is a violation of a fundamental human right. Racial discrimination is illegal in many countries. Unfortunately, such laws tend not to be enforced very often.

Racial intolerance is a very sensitive issue. Although racial intolerance has decreased since the beginning of the 20th century, it has not been fully eliminated. Racism manifests itself through a variety of different forms. Racism is caused by fear and ignorance, promotes unnecessary violence and hatred, and promotes the use of false stereotypes. These reasons only reinforce an opinion shared by almost every civilized human. To fight racism we must educate our next generation to accept and understand the concept of racial equality. The only way this can happen is through attacking the problem in everyday life interactions.
